These Terms and Conditions of Sale govern purchases made through the Mama Curve™ website, operated by KAGLIA LLC.

By placing an order on our website, you agree to these Terms and Conditions, as well as our Privacy Policy, Shipping Policy, and Refund Policy.

KAGLIA LLC may update these Terms from time to time. The terms applicable to an order are those in effect at the time the order is placed.

Nothing in these Terms limits any mandatory consumer rights available to you under applicable Canadian or provincial law.

ARTICLE 2 — PRODUCTS

Mama Curve™ offers postpartum shapewear, support garments, and related wellness products.

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizing information, and other details are accurate.

However, colours and appearance may vary slightly depending on your screen, lighting, production batch, or other factors.

Product availability is subject to change without notice.

ARTICLE 3 — ORDERS

Orders are placed online through our website.

The ordering process generally includes:

• selecting your product, size, colour, and quantity;
• adding the product to your cart;
• entering your shipping and billing information;
• reviewing your order;
• completing payment.

You are responsible for providing accurate and complete information, including your shipping address.

A customer account is not required to place an order unless otherwise indicated.

If a paid order is cancelled by us, the applicable amount will be refunded to the original payment method.

Prices

Prices are displayed primarily in Canadian dollars (CAD) for customers in Canada.

Any applicable taxes and charges will be displayed during checkout where required.

Prices, promotional offers, discounts, and product availability may change without notice.

However, changes will not affect orders that have already been confirmed.

• other payment methods offered through Shopify Checkout.

Payment information is processed securely by our payment providers. Mama Curve™ does not store complete payment card information.

ARTICLE 6 — SHIPPING AND DELIVERY

Shipping Area

Mama Curve™ currently ships to eligible addresses in Canada and any additional destinations displayed as available during checkout.

Processing Time

Orders are generally prepared within 24 to 72 hours.

Estimated Delivery

Most orders arrive within approximately 7 to 12 business days after shipment.

Delivery times are estimates and may occasionally be affected by carrier delays, weather, customs procedures, peak shopping periods, or other circumstances outside our reasonable control.

Tracking

When tracking is available, tracking information will be sent after your order has shipped.

Customers are responsible for ensuring that the shipping address entered at checkout is correct.

ARTICLE 7 — RETURNS AND REFUNDS

Mama Curve™ offers a 90-Day Money-Back Guarantee, beginning on the date your order is delivered.

You may try Mama Curve™ under normal conditions and decide whether it is right for you.

If you are not satisfied, contact us within the 90-day period to request assistance with a return, size exchange, or refund, subject to our Refund Policy.

Return Requests

Please include:

• your order number;
• the email address used for the order;
• the reason for your request.

Return instructions will be provided after your request has been reviewed.

Please do not send products to the company’s registered business address unless specifically instructed to do so.

Return Shipping

Unless otherwise required by applicable law or stated by us, return shipping costs are the customer’s responsibility.

Mama Curve™ will cover reasonable return or replacement costs when an item is:

• defective;
• damaged upon arrival;
• materially different from what was ordered;
• incorrectly shipped by us.

Damaged or Incorrect Orders

If your order arrives damaged, defective, or incorrect, contact us as soon as possible and include photographs where appropriate so we can resolve the issue.

Refund Processing

Once an approved return has been received and reviewed:

• we aim to process the refund within 5 business days;
• the refund will be issued to the original payment method;
• your bank or payment provider may require additional time for the refund to appear.

ARTICLE 8 — PROMOTIONS AND DISCOUNTS

Promotional offers, bundle discounts, free products, discount codes, and limited-time offers may be subject to additional terms displayed at the time of purchase.

Unless otherwise stated, promotional offers:

• cannot be exchanged for cash;
• may not be combined with other promotions;
• may be changed or withdrawn before an order is placed.

Any advertised quantity limitations or stock notices should reflect actual availability.

ARTICLE 9 — PRODUCT USE

Mama Curve™ products are intended for personal use according to the instructions provided.

Customers should stop using a product if it causes significant discomfort, irritation, or another unexpected reaction.

Postpartum recovery varies from person to person. Customers recovering from childbirth, surgery, or a C-section should follow the advice of their qualified healthcare provider regarding when compression garments are appropriate for them.

Information provided on our website is for general informational purposes and is not a substitute for individualized medical advice.

ARTICLE 10 — LIABILITY

To the extent permitted by applicable law, KAGLIA LLC is not responsible for losses resulting from:

• misuse of a product;
• failure to follow product instructions;
• circumstances outside our reasonable control;
• delays caused by third-party carriers;
• indirect or consequential losses that could not reasonably have been anticipated.

Nothing in these Terms excludes or limits liability or consumer rights where such exclusion is prohibited by law.

Nothing in these Terms is intended to waive rights that cannot legally be waived.
